JUSTICE SUDHIR SINGH ORAL ORDER 28-06-2017 Earlier bail application of the petitioner was rejected vide order dated 18.10.2016 in connection with Special (POCSO) Case No. 52 of 2014, arising out of Parsa Bazar P.S. Case No. 188 of 2014, pending the court of learned 1st Additional Sessions Judge, Patna, with a direction to the court below to conclude the trial within a period of three months' from the date of receipt/production of a copy of the order. The District Magistrate, Patna and Senior Superintendent of Police, Patna, were also directed to take necessary steps to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below so that the trial could be concluded within the stipulated period.

The court below vide Letter No. 117/16 dated

Patna High Court Cr.Misc. No.30805 of 2016 (5) dt.28-06-2017 2/2 08.06.2017, has sought for further two months' time to conclude the trial. It has further been stated that five witnesses have already been examined and only three witnesses are yet to be examined. Considering the aforesaid facts and circumstances, further two months' time is granted as per request made by the court below for concluding the trial from the date of receipt/production of a copy of this order.

The District Magistrate, Patna and the Senior Superintendent of Police, Patna are also directed to ensure that the remaining prosecution witnesses are produced on the date fixed by the court below so that the trial could be concluded within the stipulated period.

Let a copy of this order be communicated to the District Magistrate, Patna and the Senior Superintendent of Police, Patna also.
