The appellant is apprehending his arrest in connection with Salimpur P.S.Case No.13 of 2017 , registered for offences punishable under Sections 341, 323, 376, 504, 120(B) of the Indian Penal Code and Section 3(1)(r)/3(i)(w) of Scheduled Caste/Scheduled Tribe (Prevention of Atrocities) Act. Allegation against the appellant is of having physical relation with the informant on the pretext of marriage and thereafter brought her back to his house and fled away and there is further allegation against the relatives of the appellants that they abused her by caste name.

Submission of the learned counsel for the appellant is that the informant is married lady and the appellant was also a married person, as such the allegation is false and concocted and the informant is major also. The allegation of abusing by caste name is against the parents of the appellant. Heard learned Spl. P.P.

APP (SJ) No.1129 of 2019 dt.16-04-2019 2/2 Having heard both sides and in view of the facts and circumstances as stated above, I am not inclined to grant privilege of anticipatory bail rather let the appellant surrender before the learned Special Judge within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned special judge on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day. Accordingly, this appeal is dismissed.
