The petitioner seeks bail in Puraini P.S. Case No. 102 of 2017 registered under Section 392 of the Indian Penal Code.
Motorcycle of the informant is said to have been looted by three unknown motorcycle borne criminals. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. He was not put on T.I.P. He has no criminal antecedent. He has been languishing in custody since 26.08.2017.
Patna High Court Cr.Misc. No.1112 of 2018 (2) dt.10-01-2018 2/2 Petitioner and co-accused, namely, Md. Samir @ Matwala are said to have been arrested by the police on the disclosure of the informant, but the aforesaid co-accused Md. Samir @ Matwala has been enlarged on bail by learned lower court. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Udakishanganj, Madhepura in connection with Puraini P.S.
