The petitioners seek bail in connection with Dumariya P.S. Case No. 16/2015 dated 07.03.2015 instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code. The father of the informant was killed and his dead body was dumped in the chamber of the brick kiln. The petitioners and seven others have been named in the F.I.R. by the informant of having killed the deceased. Though, no specific allegation has been levelled against any of them but they along with petitioners have been named in the F.I.R. because they had threatened the deceased in the past. There is no eye-witness to the occurrence and
Patna High Court Cr.Misc. No.56838 of 2017 (2) dt.04-12-2017 2/2 under similar circumstances other accused persons have been granted bail.
Regard being had to the aforesaid facts and taking into account the period of custody of the petitioners, this Court is inclined to grant bail to them.
The petitioners above named are directed to be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S. Case No. 16/2015.
