20-09-2018 Heard Sri Gautam Kumar Kejriwal, learned counsel for the petitioner and Sri Ram Naresh Ray, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Gopalganj P.S. Case No. 414 of 2016 registered for offence under Sections 420 and 406 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner, by way of drawing my attention to F.I.R., submits that informant is none else, but own brother of the petitioner and in a family business, false accusation has been made, as if, petitioner has grabbed the business of the informant.
After hearing and considering the fact disclosed in the F.I.R., I am of the opinion that it is a fit case for grant of
Patna High Court Cr.Misc. No.58706 of 2018(2) dt.20-09-2018 2/2 anticipatory bail.
Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Uma Shanker Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 414 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
