JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 07-04-2016 in a case registered under Sections-323, 376 & 354/34 of the Indian Penal Code.

Originally, the informant filed complaint case, which was converted into police case.

The accusation against the petitioner is that he established physical relation with the informant on false promise of marriage but the first informant report reflects that the informant is a deserted lady and she, herself admitted in her written report that the physical relation with the petitioner was established in the year, 2013 and in the year, 2015, the petitioner

Patna High Court Cr.Misc. No.31009 of 2016 (2) dt.11-08-2016 2/2 refused to solemnize his marriage with her.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahila P.S. Case No. 23 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Hajipur, Vaishali.
