JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 17.05.2015 in connection with Sessions Trial No. 789 of 2015, arising out of Barh P.S. Case No. 193 of 2015 for the offences instituted under Sections 302 and 120(B)/34 of the IPC.

The prosecution story, in brief, is that the petitioner alongwith her brother Manoj Kumar and her lover, Ghanshyam Singh killed her husband( the brother of the informant). The earlier bail application of the petitioner was rejected vide Annexure-9 to the present application. The said application was rejected with the direction to the court below to conclude the trial preferably within a period of six months from the date of

Patna High Court Cr.Misc. No.32493 of 2016 (6) dt.14-12-2016 2/2 receipt/production of copy of the order. Against the said order, the petitioner had preferred an application before the Apex Court(Supreme Court). The said application was also rejected. A report was called from the court below regarding the stage of the case. It has been reported that in three months the trial is expected to be concluded.

Considering the aforesaid facts and circumstances, I find no reason to interfere with the earlier order. The application is, accordingly, rejected in Sessions Trial No. 789/2015, arising out of Barh P.S. Case No. 193 of 2015, pending in the court of learned A.D.J. VIth, Barh, Patna.

The court below is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of copy of the order. U.K./- (Sudhir Singh, J) U T
