Patna High Court Cr.Misc. No.34267 of 2015 (2) dt.24-08-2015 2/3 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 504 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons came variously armed, abused the informant by calling caste name when petitioner no. 1 Satrughan Chouhan and petitioner no. 2 Bhagelu Chouhan assaulted the informant with lathi.

It is submitted by learned counsel for the petitioners that in the background of serious land dispute the accusation has been levelled when D.C.L.R. decided the Land Dispute Case No. 50/2013-14 in favour of the petitioners. Moreover, none received any injury.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation in the background of land dispute and counter version of the occurrence, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand)
