JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 406, 407, 408 and 120B/34 of the Indian Penal Code.
Allegation against petitioner, who is driver of informant, is that he himself had made the vehicle of informant missing. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 15.3.2016. Chargesheet has been submitted against him. There is no allegation of tampering of witnesses against him. He has been made accused merely on the basis of suspicion. On behalf of the State, it is submitted that petitioner is named in the F.I.R. In course of investigation specific allegation has been levelled against petitioner who had taken away the
Patna High Court Cr.Misc. No.32967 of 2016 (4) dt.25-11-2016 2/2 vehicle of informant. Onus is upon petitioner to explain regarding the missing vehicle.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
