====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhagwanganj P.S. Case No. 99 of 2021 lodged under Sections 341, 323,147, 148, 149, 302, 120(B) of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that the present case has been filed against 12 known persons in which role of almost all persons have been well-explained from the allegation made in the F.I.R. It is stated that the allegation made in the F.I.R. is general omnibus against the petitioner and some other accused persons whereas specific allegation upon one Gunjan Kumar to kill his brother by putting gun shot on the head. The petitioner is in custody since 21.10.2021 and charge

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and the submissions made above of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two sureties, one shall be the close relative of the like amount each to the satisfaction of learned Additional District and Sessions Judge Masaurhi in connection with Bhagwanganj P.S. Case No. 99 of 2021, subject to the conditions as laid down under Section 437(3) of the Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
