The sole petitioner, who is in custody since 12.05.2016 in connection with Dhaka P.S. Case No.114 of 2016 registered for the offence under Sections 272 , 273 of the Indian Penal Code and Section 47 (a) of the Excise Act/ 47 of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner was apprehended on an allegation of recovery of six liters of Nepali foreign liquor. Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

No.31962 of 2016 (2) dt.16-08-2016 2/2 However, keeping in view the nature of accusation and period of custody, let the petitioner, namely, Subhash Kumar, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka in connection with Dhaka P.S. Case No.114 of 2016.
