JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seek regular bail in connection with Siswan P.S. Case No. 148 of 2017 instituted for the offences under Sections 272, 273 and 308 of the Indian Penal Code and Sections 41(1) and 30(A) of the Bihar Excise & Prohibition Act, 2016. The allegation is regarding recovery of 86 litre of illicit liquor from the bush behind the house of the petitioners and the hut in front of the house.
The learned counsel for the petitioners submits that no recovery has been effected from the conscious possession of the petitioners. The petitioners are accused in one other case of same and similar nature and they are languishing in custody since
Patna High Court Cr.Misc. No.58735 of 2017 (2) dt.22-12-2017 2/2 13.10.2017.
Considering the nature of accusation and the period of custody already undergone, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IInd, Siwan in connection with Siswan P.S. Case No. 148 of 2017.
