The petitioner seeks regular bail in connection with Bela P.S. Case No. 177 of 2015, registered for the offence punishable under Sections 395 of the Indian Penal Code and Section 3 /4 of the Explosive Substance Act.
The allegation is regarding unknown persons having committed dacoity, whereafter the accused persons have been arrested on suspicion.
The learned counsel for the petitioner submits that the name of the petitioner has transpired upon confessional statement having been made by the co-accused person, namely, Md. Alauddin, however, neither any Test Identification Parade has been held nor any recovery has been
Patna High Court CR. MISC. No.18211 of 2019(2) dt.02-04-2019 2/2 made from the petitioner herein. It is stated that though the petitioner is an accused in one other case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 6.2.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S.
