The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code.

It is alleged that six First Information Report named accused persons including the petitioner came variously armed along with 10-12 persons, when Raja assaulted on the head of the informant by the butt of the pistol. Raja ordered to Rahul, Tuni, Gautam and Buchhi to kill the informant. Rahul assaulted the informant with hockey stick. When brother of the informant came to rescue the informant then Rahul, Buchhi, Tuni along with 10-12 unknown assaulted the informant and his brother. It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.35286 of 2015 (2) dt.20-08-2015 petitioner that the petitioner alleged to have made assault to the informant, when informant has only received bruise, abrasion and one lacerated injuries. Injury of informant's brother has been found simple. It is submitted that the informant has retracted from the initial version and filed a petition to that effect before learned court below. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, learned Judicial Magistrate, Ist Class, Patna in connection with Kadamkuan P.S. Case No. 480 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
