JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Jakkanpur P.S. Case No. 20 of 2019, disclosing offences under Sections 419, 420, 290, 120(B), 34 of the Indian Penal Code, Section 11 of the Gambling Act and Section 3⁄4 of the Banga and Bihar Lottery Act.

Prosecution story is that police received information of gambling going on in the house of one Lal Babu Choudhary and police raided the place of occurrence and arrested some persons and on their disclosure, the name of the petitioner transpired and it further appears that petitioner is accused in similar type of also.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case only on the basis of confessional statement of co-accused persons

Patna High Court CR. MISC. No.20415 of 2019(2) dt.07-05-2019 2/2 and he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Patna (Sub-Judge-1) District, Patna, in connection with Jakkanpur P.S. Case No. 20 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that if he is found in such type of case in future, the prosecution is at liberty to move for cancellation of his bail bonds.
