Earlier prayer for bail of the petitioner was rejected by this court vide order dated 03-12-2015 passed in Cr. Misc. No. 54173 of 2015 but submission on behalf of the petitioner is that the petitioner is languishing in jail custody for near about 14 months and as a matter of fact, Sections-4 & 5 of Explosive Substance Act 1908 are not applicable in this case and so far as recovery of cartridge is concerned; the petitioner has sufficiently been punished by remaining in jail custody since long.
