The petitioner seeks bail in a case registered under Sections 147, 148, 149, 326, 307, 504, 506 of the Indian Penal Code and Section-27 of the Arms Act.

The prosecution case in brief is that while the informant was passing road in front of his house, the accused persons came there and started abusing. They exhorted to shoot because he has not withdrawn the case. The accused persons fired from their pistols, as a result of which, the informant sustained firearms injury. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No. 17534 of 2019(4) dt.09-05-2019 2/2 petitioner. The petitioner is in custody since 11-02-2019. Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioner. No specific overt act has been attributed to the petitioner. The petitioner has been falsely implicated in this case due to previous enmity. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial Area) P.S. Case No. 14 of 2019.
