The petitioners apprehend their arrest in Sri Krishnapuri P.S. Case No.244 of 2017 registered under Section 307 and other Sections of the Indian Penal Code. The informant alleged that her husband Appu Singh is mentally abnormal. Her mother-in-law and brother-in-law Sohan Singh came and caught her. They all assaulted her. She further alleged that Appu Singh and Sohan Singh assaulted her with iron rod on her head and her sister-in-law snatched chain from her possession.

The learned counsel for the petitioners submits that wife of the petitioner no.1 filed Execution Case No.255 of 2015

Patna High Court Cr.Misc. No.57167 of 2017 (2) dt.18-12-2017 alleging therein that her husband is mentally abnormal. The informant alleged that both the petitioners assaulted her with iron rod on her head but from perusal of the injury report, Annexure 2 it would appear that one abrasion over head was found. No apparent injury was found on other parts of the body. Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the petitioners are husband and brother-in-law of the informant, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Praveen Kumar Singh, learned A.C.J.M., Patna in connection with Sri Krishnapuri P.S. Case No.244 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
