JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2022 The present writ petition has been filed seeking the following reliefs:- "A). To direct the respondent Circle Officer, Thakurganj to remove the encroachment from the land appertaining to Plot No. 4136 and 4137 under Khata No. 656 situated within Mauza-Powakhalli under Thana No. 222, Anchal-Thakurganj in the district-Kishanganj.

B) To pass appropriate order/direction for suitable action against the Circle Officer, Thakurganj for his willful and deliberate non-observance of his statutory duty to remove the encroachment under the Bihar Public Land Encroachment Act, 1956."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Thakurganj, District-Kishanganj for redressal of his

Patna High Court CWJC No.10175 of 2021(2) dt.08-09-2022 2/2 aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Thakurganj, District-Kishanganj by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
