The petitioner seeks bail in connection with Civil Lines (Gaya) P.S. Case No. 241 of 2019 for the offence under Sections 365 and later on Sections 302, 201 and 120(B) of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has been made accused merely on the basis of suspicion and he has been taken into custody after eight months of the alleged occurrence and since 05.12.2019 he has been languishing in judicial custody.

Patna High Court CR. MISC. No.17478 of 2020(4) dt.09-07-2020 2/2 Learned A.P.P. for the State as well as the counsel for the informant opposed the prayer for bail and submitted that the petitioner happens to be husband of the victim and he is solely responsible for the alleged occurrence. Moreover, the witnesses have supported the prosecution version which is evident from the case diary.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. (Arvind Srivastava, J) brajesh/- U T
