ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Kudra P.S. Case No.79 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that admittedly, the occurrence took place on account of construction of boundary wall in the main Rasta and it was neither premeditated nor was such as to cause serious threat to the lives. Learned counsel further submitted that the injuries as occasioned are simple in nature.

No.32284 of 2015 (2) dt.17-08-2015 2/2 Considering the aforementioned facts and circumstances and the nature of dispute and also the fact that the petitioner have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Kudra P.S. Case No.79 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
