The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 341, 323, 337, 338, 307, 504 of the Indian Penal Code.

It has been urged on behalf of the petitioner that except for the petitioner having been named in the F.I.R, there is no specific accusation against him. The accusation of assaulting the deceased is on four other accused persons and not on the petitioner. Moreover, similarly situated co-accused have been granted privilege

Patna High Court CR. MISC. No.19763 of 2022(2) dt.28-09-2022 2/2 of anticipatory bail by a coordinate Bench of this Court vide order dated 07.02.2022 passed in Cr. Misc. No. 17139 of 2021.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 368 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
