Learned counsel for the petitioner submits that petitioner is accused in Saraiya P.S. Case No.884 of 2022, dated 30.11.2022 under Section 302 /120B of the I.P.C. and seeks permission to make proper investigation.

Counsel for petitioner submits that he is pressing only one prayer before this Court and not pressing the other prayers i.e. 1(ii), 1(iii) and 1(iv).

Patna High Court CR. WJC No.642 of 2023(2) dt.04-05-2023 2/2 Counsel for State submits that there are two criminal cases pending against the petitioner and he is evading his appearance from both the cases.

Liberty is hereby granted to the petitioner that he file his representation before the Senior Superintendent of Police, Muzaffarpur (Respondent no.2) within four weeks from the date of passing of this order, in the light of order passed in Surendra Singh Vs. State of Bihar and Ors in Cr.WJC No.153 of 2017 with analogous cases decided on 09.09.2022, but with no protection.

The Senior Superintendent of Police, Muzaffarpur (Respondent no.2) is directed to take necessary steps for completion of fair investigation at the earliest. With the aforesaid direction, the present Criminal Writ Application is hereby disposed off.
