Petitioner prays for bail in connection with Barbigha P.S.Case No. 15 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is named in the FIR and allegation of assault is against other co-accused persons and it appears that petitioner has been made accused in six other cases.
Submission of learned counsel for the petitioner is that there is no allegation of assault against the petitioner, rather he has only been named in the last portion of FIR and he is in custody since 31.7.2018 and though there are cases against the petitioner but he is on bail in those cases.
Patna High Court Cr.Misc. No.55062 of 2018 (2) dt.10-10-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S.Case No. 15 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
