The petitioner is languishing in custody since 10.01.2019 in connection with Galgalia P.S. Case No.5 of 2019 registered for the offences punishable under Section 414 of the Indian Penal Code and 11(a)(d) of Prevention of Cruelty to Animal Act.

The prosecution case is that the petitioner was intercepted while smuggling a group of cattle from Nepal to India.

It is submitted by learned counsel for the petitioner that the petitioner is a labourer and only on the basis of suspicion, the petitioner has been roped in the present case. It is

Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that the petitioner was smuggling the bunch of cattle.

Considering the nature of accusation and the period under custody coupled with the fact that petitioner is not having criminal antecedent, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Galgalia P.S. Case No.5 of 2019.
