JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,323,341,504,506 and 379 of the Indian Penal Code and section 138 of N.I. Act.
It is alleged that the informant supplied grains to the petitioner on credit. Subsequently, son of the petitioner issued two cheques of Rs.1,00,000/- and Rs.85,000/- respectively which got bounced.
It is submitted by the learned counsel for the petitioner that the cheques were issued by the son of the petitioner. The informant retracted from the initial version and has filed a petition to that effect before the learned court below (Annexure 2 and 3).
Patna High Court Cr.Misc. No.32516 of 2015 (2) dt.10-08-2015 2/2 Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari in connection with East Champaran (Motihari) Town P.S. Case No.422 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
