The petitioner, in the present case, is seeking regular bail in connection with Delha P.S. Case No 184 of 2017, registered for offences alleged under Sections 380, 457 of the Indian Penal Code.
As per the F.I.R., the petitioner was allegedly caught while he was trying to flee away after committing theft in the house of the informant.
Learned counsel for the petitioner has submitted that the allegations are false as nothing has been recovered from possession of the petitioner. He further submits that the petitioner is on bail in one case being Delha P.S. Case No. 132 of 2017 for
Patna High Court Cr.Misc. No.63751 of 2017 (2) dt.11-01-2018 2/2 the offence alleged under Sections 401 and 413 IPC. However, the statement to that effect is not there in the application. Learned APP opposed the prayer for bail.
Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Delha P.S. Case No 184 of 2017 subject to the conditions U/S 437(3) Cr.P.C and on his showing the bail order in connection with the case being Delha P.S. Case No. 132 of 2017.
