JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-01-2023 It is submitted on behalf of the petitioner that during pendency of the case, grievances of petitioner Nos. 1, 2 and 4 have already been redressed and as such, writ application with respect to petitioner Nos. 1, 2 and 4 has become infructuous.

Patna High Court CWJC No.17025 of 2014(3) dt.31-01-2023 2/3 Petitioner No. 3 has moved to the Court for following reliefs:- i.

For directing the respondent authorities to consider the case of promotion of the petitioner into Class-III in Clerical Cadre.

ii.

For directing the respondent authorities to pay the salary and other emoluments of Class-III post of clerk from the date of such promotion. iii. For any other relief or reliefs for which the petitioner is found entitled to in the facts and circumstances of the case.

Learned counsel for the petitioner draws the attention of this court to the order passed by a learned Single Judge dated 07.02.2022 in CWJC No. 6074 of 2021, by which a similarly situated person namely, Saroj Bala Devi had moved the Court and the matter was disposed of with a direction to the concerned respondent to examine the service particulars of the petitioner and his immediate junior who is stated to have been promoted to Class-III.

Learned counsels agree that the matter be disposed of in similar terms.

Having regard to the aforesaid, the writ petition stands

Patna High Court CWJC No.17025 of 2014(3) dt.31-01-2023 3/3 disposed of with similar direction as has been passed by the learned Single Judge in order dated 07.02.2022 passed in CWJC No. 6074 of 2021.
