JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioners and the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,325,307,379/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged by the informant that while he was returning from Sinjhua to Mohania along with Binod Singh and Akhilesh, the accused persons got his car stopped near Gara Choubey canal and fired and assaulted them by lathi and danda which caused injury on their head thereafter the accused persons snatched away a gold chain and Rs. 10,000/-. On alarm when the villagers came, then all the accused escaped leaving their motorcycle.
Patna High Court Cr.Misc. No.32434 of 2015 (2) dt.10-08-2015 2/2 It is submitted by the learned counsel for the petitioners that allegations levelled again the petitioners is general and omnibus as the petitioner no. 2 filed Complaint Case No. 662 of 2015 against the informant since the informant snatched his Honda motorcycle.
The aforesaid facts constitute a good ground for consideration of regular bail, if the petitioners surrender within a period of six weeks in connection with Mohania P.S. Case No. 216 of 2015 pending in the Court of Chief Judicial Magistrate Bhabhua.
With the observations above, the application stands disposed off.
