The petitioners apprehend their arrest in Sonpur (Pahleja OP) P.S. Case No. 585 of 2021, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.

As per the FIR, petitioners are bent upon construction of Nal Jal Yojana on a piece of land claiming to be their own on the basis of forged and fabricated sale deed. It is submitted that petitioners have been falsely implicated in this case in retaliation to a Title Suit No. 83 of 2021 which is pending with regard same piece of land in which

No.20536 of 2022(2) dt.01-09-2022 2/2 informant, his father and uncle are the defendants and only after receiving notice in the said title suit the present criminal case has been filed against petitioners. Moreover, dispute is of civil nature. Petitioners claim clean antecedent.

Counsel for the informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonpur (Pahleha OP) P.S. Case No. 585 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
