====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 333, 307, 504 and 353/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioner is a person with clean antecedent. The informant alleges that one Brajesh Kesari was arrested as he was found in drunken condition and when he was being taken to the police station it is alleged that about 100 persons including the petitioners blocked, surrounded the police vehicle and tried to free Brajesh Kesari from the police custody. Learned counsel for the petitioners submits that

No.28921 of 2023(2) dt.24-06-2023 2/2 petitioners have been falsely implicated at the instance of the Chawkidar and similarly situated co-accused has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 30.05.2023 in Cr. Misc. No. 35515 of 2023. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sherghati P.S. Case No. 982 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
