JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 147, 148, 149, 341,323,324,307,504,379 of the Indian Penal Code. The prosecution case is that when the informant and his brother were sitting at their door, all the accused persons came and started abusing them. On protest being made Md. Mistar caught him and Sahid and Guddu assaulted with lathi. When his brother came to rescue Md. Mistar caused injury with knife to him and when his family members came to rescue, Md. Anwar, Kismat Miyan and Jamil Miyan made assault as a result Md. Nayeem fell down on earth then Md. Jamil assaulted him by Farsa thereafter petitioner along with others took away a golden chain and Rs.
Patna High Court Cr.Misc. No.32437 of 2015 (2) dt.10-08-2015 2/2 10,000/-.
A statement has been made in paragraph no. 3 that petitioner has no criminal antecedent.
Considering the accusation of assault not being specific against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Rosera P.S. Case No. 132 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
