JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B, 120B and 34 of the Indian Penal Code.
Accusation is of killing the daughter of the informant after three years of marriage for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that the husband of the victim has been acquitted, after facing trial in Sessions Trial No. 83 of 2015 vide judgment dated 30th May 2015 passed by the learned Additional Sessions Judge-XI, East Champaran, Motihari, the certified copy of the said judgment has been produced before this court, let the same be kept on record. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.32458 of 2015 (2) dt.10-08-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in connection with Mufassil P.S. Case No.300 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
However, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
