Petitioner prays for bail in connection with Sessions Trial No. 110 of 2018, arising out of Mansi P.S.Case No. 172 of 2017 registered for the offences punishable under Sections 364/34 and subsequently Sections 302, 201 and 120B/34 of the Indian Penal Code were added.
Petitioner is not named in the FIR and later on his name transpires and it is alleged that mobile phone of the petitioner was used in the crime. It appears that earlier prayer for bail of the petitioner was rejected vide order dated 4.4.2018 passed in Cr.Misc.No. 10916 of 2018 by the then co-ordinate Bench of this Court.
Submission of learned counsel for the petitioner is that he
Patna High Court Cr.Misc. No.54971 of 2018 (3) dt.10-10-2018 2/2 has been made accused only on the basis of suspicion and he is in custody for more than one year and charge has already been framed in this case and he is ready to abide by any condition that may be imposed on him.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Khagaria, in connection with Sessions Trial No. 110 of 2018, arising out of Mansi P.S.Case No. 172 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear before the court as and when required, otherwise his bail bond shall be cancelled.
