JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 This application, for grant of anticipatory bail, arises out of Turakauliya (Raghunathpur) P.S. Case No. 650 of 2018, disclosing offences under Sections 25(1-b)a/26/35 of the Arms Act and Section 30(a)/38/41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that the police went to the house of the petitioner to arrest him in another case but petitioner succeeded in fleeing away, however, on raid to the outhouse of the petitioner, 180 Ml. Bottle and one magazine containing two cartridges were recovered.

Submission of learned counsel for the petitioner is that he is innocent and has falsely been roped in the case and the articles recovered from his outhouse appears to have been

Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
