JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-08-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Kaji Mohammadpur P.S. Case No. 305 of 2014, disclosing offences under Sections 363, 365 and 366A of the Indian Penal Code.

From the First Information Report, it appears that the F.I.R. was instituted on the basis of the suspicion that the victim girl was taken away by one Vikash Kumar under some inducement with the help of other co-accused persons including these petitioners.

Learned counsel for the petitioners has submitted that petitioner no. 1 is the sister of said Vikash Kumar, whereas

He has further submitted that the prosecution case, as narrated in the First Information Report, indicating involvement of these petitioners, is highly improbable. Considering the submission and the fact that the petitioners are ladies, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Kaji Mohammadpur P.S. Case No. 305 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
