The present petition has been filed with a prayer to restore C.W.J.C. No. 23209 of 2012 which stood dismissed due to non -compliance of peremptory order dated 17.1.2013. In this case supplementary affidavit has also been filed on behalf of the petitioner in which it has been indicated that Title Suit No. 36 of 2007 is pending for argument.

After hearing learned counsel for the petitioner and considering the facts disclosed in the present petition, same is allowed.

Let C.W.J.C. No. 23209 of 2012 be restored to its original file.

It is clarified that if the order dated 17.1.2013 is not

Patna High Court MJC No.3660 of 2014 (4) dt.02-02-2017 2/2 complied within four weeks from today, the writ petition i.e. C.W.J.C. No. 23209 of 2012 shall stand dismissed without further reference to a Bench.
