The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code. As per written report of informant Chowkidar 2/9 Jamuna Ram, prosecution story in brief is that he received information that one unknown person is being beaten by people near Budhi river. On that information the informant reached and saw a lot of people gathered and assaulted an unknown person knowing child thief and after some times he died.

Patna High Court CR. MISC. No.22837 of 2024(2) dt.04-04-2024 2/3 Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. FIR has been registered against unknown. The name of the petitioner has been added in this case mere on suspicion as in a video clip, he was seen at the time and place of occurrence. He was simple a member of the mob. No specific overt act has been alleged against the petitioner. There is no consistent evidence in support of complicity of this petitioner. There is no eye witness of the alleged offence. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, petitioner is languishing in judicial custody since 31.10.2023. Similarly situated several co-accused persons have been granted bail by this Court.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is

Case No. 310 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sadar, Motihari.
