The petitioner is languishing in custody since 14.01.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A and 494 of the Indian Penal Code.

Basic accusation is of torture and performing second marriage.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and he is ready to keep her as wife with full dignity and honour. A statement to that effect has been made in paragraph 10 of the petition, which reads as under :-

Patna High Court Cr.Misc. No.32592 of 2016 (2) dt.03-08-2016 2/2 "That the petitioner is always ready to keep his wife and his child with full dignity and respect." It is further submitted that since the complainant deserted the petitioner, the petitioner performed second marriage. Moreover, the investigation has already concluded. Considering the nature of accusation, investigation has already concluded and the petitioner has remained in custody for about six months, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Purnea, in connection with Complaint Case No.831/2014.
