Petitioner prays for bail in connection with Rudrapur P.S.Case No. 18 of 2018, G.R.No. 372 of 2018, registered for the offence punishable under Section 394 of the Indian Penal Code. Allegation of commission of dacoity in the house of the informant and petitioner is not named in the FIR and later on his name has transpired in the confessional statement of co-accused and there is recovery of Rs.26,000/- from his house and he is accused in four other cases.
Submission of learned counsel for the petitioner is that the money was kept in his house for the purpose of marriage of his daughter and the same is not looted money. Further submission is that co-accused, in whose confession name of petitioner has
Patna High Court Cr.Misc. No.54995 of 2018 (2) dt.10-10-2018 2/2 transpired, has been granted bail by this Court. Heard learned APP also.
Having heard both sides and in view of allegation and criminal antecedents of the petitioner, I am not inclined to grant bail to the petitioner at this stage.
However, petitioner may renew his prayer for bail after framing of charge in this case.
