Petitioner apprehends arrest in connection with Madhaura0Marhowrah P.S. Case No. 990 of 2020 registered for the offence under sections 363/366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no committed any offence as alleged in the first information report and he has been falsely implicated in this case due to ulterior motive. Moreover, a counter affidavit has been filed on behalf of the victim stating therein that she and the petitioner have solemnized marriage and it is not a case of kidnapping. Case No. 990 of 2020 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
