JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/ 34 of the Indian Penal Code and Section 30(a) of the Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 27.01.2022, charge-sheet has been submitted in this case and has antecedent of two cases. Allegation is of recovery of 65.100 litre of liquor from the motorcycle of the petitioner.

The learned counsel for the petitioner submits that petitioner had parked his motorcycle and had gone to meet his friend when he came back, he saw that police personnel were present and it was alleged that the liquor belonged to him. It is

Patna High Court CR. MISC. No.20252 of 2022(2) dt.29-04-2022 2/2 submitted that petitioner was completely unaware, who had kept the liquor on the seat of the motorcycle in his absence. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Laukahi (Narhiya) P. S. Case No.25 of 2022. The application stands allowed.
