The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 504 and 506 of the Indian Penal Code and sections 25 (1-B) (a) and 27 of the Arms Act.

As per the prosecution case, it is stated by the informant that the petitioner threatened that the earlier case lodged by the informant should be withdrawn and started to fire. The informant started to run away and the shots fired by the petitioner missed him.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are false and concocted. The informant is the uncle

Patna High Court CR. MISC. No.28921 of 2021(2) dt.10-12-2021 2/2 of the petitioner and the false implication is because of family dispute between the parties. The petitioner is in custody in the instant case since 15.10.2020. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Wazirganj P.S. Case no.338 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Gaya.
