JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section47(A) of the Excise Act. Allegedly, illegal liquor factory was unearthed from the premises of the petitioner but according to prosecution case itself, only two litres illicit liquor and 15 kg. illegal Java mahua were recovered from the premises of the petitioner, for which, petitioner is in jail custody since 06-05-2016 without having any criminal antecedent.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.26109 of 2016 (2) dt.11-07-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Case No. 275 (C-2) of 2016 to the satisfaction of learned Chief Judicial Magistrate, Patna.
