JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Sirdalla P.S. Case No.04 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
Allegation as per F.I.R. is that the Police on information raided the place of occurrence where the liquor was manufacturing at the bank of Dhobani River and the petitioners and other accused persons succeeded in fleeing away, however, liquor was recovered from spot.
Submission of the learned counsel for the petitioners is that they have no criminal antecedent and they have falsely

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional District Judge-II-cum- Special Judge, Nawada, in connection with Sirdalla P.S. Case No.04 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
