The petitioner is in custody in connection with Tajpur P.S.Case No.116 of 2017 registered for an offence under Sections 395, 397 and 412 of the IPC.
The informant of this case is the driver and owner of pick-up van. It is alleged that when he was proceeding by his van, a Bolero van accompanied by three or four miscreants came and snatched the pick-up van and started fleeing. In the meanwhile, police patrolling party came and started chasing the miscreants. In course of chase, the pick-up van met with an accident and altogether three persons from pick-up van and four from Bolero vehicle were apprehended.
It has been submitted that nothing has been recovered from the possession of the petitioner and he has been made
Patna High Court Cr.Misc. No.60470 of 2017 (2) dt.19-12-2017 2/2 accused merely on suspicion. The other apprehended accused have been allowed bail by some of the coordinate Benches of this Court in Cr.Misc.No.55664 of 2017 and Cr.Misc.No.44222 of 2017. The petitioner has clean antecedent and is in custody since 24.04.2017. He further submits that charges have already framed. The learned APP opposed the submission.
Considering the clean antecedent of the petitioner and the case of this petitioner standing on similar footing, the prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Samastipur in connection with Sessions Trial No.703 of 2017/313 of 2017 arising out of Tajpur P.S.Case No.116 of 2017.
