The petitioner seeks bail in Ramgarhawa P.S. Case No. 103/2016, instituted for the offences under Sections 302 and 201 of the Indian Penal Code.
In the written report, it is alleged that this petitioner took the husband of informant with him but her husband did not return. It is further alleged that on the next day, dead body of her husband was found in the Sikrahana River. The informant has raised suspicion against this petitioner.
Learned counsel for the petitioner has submitted that petitioner is in custody since 25.05.2018. There is allegation against this petitioner of last seen. It is further submitted that
Patna High Court Cr.Misc. No.56498 of 2018 (2) dt.04-10-2018 2/2 besides the allegation of last seen, there is no direct allegation against this petitioner.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at East Champaran, Motihari in connection with Ramgarhawa P.S. Case No. 103/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
