The petitioners are apprehending their arrest in connection with Karjain P.S. Case No. 74 of 2012, G.R.No. 708 of 2012 registered under Sections 395 and 397 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is neither any recovery has been made from possession of the petitioners and only material against these petitioners is that their names have come on confessional statement of co-accused Binod Singh and Janardan Mehta. It is further submitted that petitioners are sons of Janardan Mehta. Out of two sons, one son is teacher and other son is preparing in competitive examination. It is further submitted that co-accused Janardan Mehta has been granted bail.
Having regard to the facts and circumstances of the case, the above named petitioners in the event of their arrest/surrender
Patna High Court Cr.Misc. No.40104 of 2014 (2) dt.22-04-2015 within a period of four weeks from the date of receipt of the order in the court below shall be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Birpur, District-Supaul, in connection with Karjan P.S Case No. 74 of 2012, G.R. No. 708 of 2012 subject to condition as laid down under Section 438 (2) of Cr.P.C. Further condition that petitioners shall produce themselves as and when required by the police.
