The petitioner apprehends his arrest in a case registered for the offence under Sections 118, 406, 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged that all the F.I.R. named accused persons including this petitioner misappropriated Rs. 30 lacs from the complainant and other persons by promising them huge return. It is submitted on behalf of petitioner that petitioner was simply an agent of the company and has no direct nexus in the financial activities of the company. It is the office bearer and Director, who were responsible for the said transaction. Entire money was deposited in the account of the company. Police, after investigation, submitted final form. Similarly situated coaccused persons have been granted anticipatory bail by this Court, vide order dated 18.12.2019 passed in Cr.Misc. No. 76944 of 2019 (Annexure 3).Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.21796 of 2023(2) dt.06-07-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Banka in connection with Belhar (Khesar) P.S. Case No. 125 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
