Petitioner seeks bail in Magadh University P.S. Case No.58 of 2010 instituted for the offence under Section(s) 452, 449, 342, 307, 302, 120-B/34 Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that there is land dispute between the parties.
In the written report, there is specific allegation against co-accused, Vijay Yadav of causing fire arm injury to Mukesh Yadav on account of which he died on the spot. There is general and omnibus allegation against the petitioner that he was also holding the deceased along with other
Patna High Court Cr.Misc. No.55587 of 2018 (2) dt.20-09-2018 2/2 accused. Petitioner is said to be in custody since 23.05.2018 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IX, Gaya, in connection with Magadh University P.S.
